Terms of Service

1. Agreement to Terms
By accessing or using Cacuda ("the Service"), operated by Cacuda Ltd ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We may update these terms at any time; continued use after changes constitutes acceptance.
2. Description of Service
Cacuda provides AI-powered content scanning services, including but not limited to AI-generated content detection, spam filtering, NSFW moderation, age verification, and automated moderation pipelines ("Automod"). The Service is provided via a web interface and a REST API.
3. Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials and API keys.
- You must be at least 18 years old to create an account.
- One person or entity may not maintain more than one free account.
- You are responsible for all activity that occurs under your account.
4. Credits and Payment
- The Service operates on a credit-based system. Different scanning operations consume different amounts of credits.
- Free accounts receive a monthly credit allocation. Paid plans provide additional credits as described on our Pricing page.
- Paid subscriptions are billed monthly in advance via Stripe. You authorise us to charge the payment method on file.
- Credits expire at the end of each billing cycle and do not roll over unless otherwise stated in your plan terms.
- Prices may change with 30 days' notice to existing subscribers.
5. Acceptable Use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these terms by reference. Violation of the Acceptable Use Policy may result in immediate suspension or termination of your account.
6. Intellectual Property
- Your content: You retain all rights to content you submit for scanning. We claim no ownership over your content and, as described in our Privacy Policy, do not retain it after processing.
- Our service: The Service, including its models, algorithms, interface, documentation, and branding, is owned by Cacuda Ltd and protected by intellectual property laws. You may not copy, modify, reverse-engineer, or create derivative works of any part of the Service.
- API output: Scan results and confidence scores are provided for your use. You may store, display, and act on these results within your own applications.
7. Accuracy and Limitations
AI detection is probabilistic, not deterministic. Cacuda provides confidence scores and classifications as decision-support tools. We do not guarantee 100% accuracy and results should not be treated as definitive proof. You are responsible for how you interpret and act on scan results.
8. Availability and Support
- We aim to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or reasons beyond our control.
- Free and Pro plan support is provided via email on a best-effort basis. Enterprise plans include SLA-backed support as agreed separately.
9. Limitation of Liability
To the maximum extent permitted by law, Cacuda Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities arising from your use of the Service. Our total liability for any claim arising from these terms shall not exceed the amount you have paid us in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that scan results are accurate, complete, or reliable.
11. Termination
- You may close your account at any time by contacting us.
- We may suspend or terminate your account if you violate these terms or the Acceptable Use Policy, or for any other reason with reasonable notice.
- Upon termination, your right to access the Service ceases immediately. We will delete your account data in accordance with our Privacy Policy.
- Sections on Limitation of Liability, Disclaimer of Warranties, and Governing Law survive termination.
12. Governing Law
These terms are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
