DMCA & Copyright Policy

Overview

Cacuda respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA") and applicable international copyright laws, we will respond promptly to claims of copyright infringement.

How Cacuda Handles Content

Cacuda is a content scanning service, not a content hosting service. Content submitted for scanning is processed in memory and immediately discarded — we do not store, publish, or redistribute your content. However, this policy applies to situations where copyrighted material may be involved in our platform's public-facing elements (documentation, user-contributed examples, etc.) or misuse of the Service.

Filing a DMCA Notice

If you believe that material accessible through Cacuda infringes your copyright, you may submit a takedown notice containing:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you claim is being infringed.
  3. Identification of the material you claim is infringing, with enough detail for us to locate it.
  4. Your contact information (name, address, telephone number, and email).
  5. A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on their behalf.

Counter-Notification

If you believe your content was removed in error, you may file a counter-notification containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the courts in your district (or England and Wales for non-US residents).

Repeat Infringers

In accordance with the DMCA, we will terminate the accounts of users who are repeat infringers in appropriate circumstances.

Misuse of the Service

Using Cacuda to systematically scan copyrighted content that you do not own or have rights to, for purposes unrelated to legitimate content moderation, may constitute a violation of our Acceptable Use Policy.
